Agricultural giant is facing thousands of lawsuits in the United States and decided to settle in this country
Bayer spends more than $ 10 billion to settle lawsuits in the United States connected to roundup, the company recently announced.
However, the agreement between Bayer and numerous law firms in the United States, does not apply to potential claims in Canada, said Tony merchant, the founder of the commercial law group.
“We don’t know right now where this will lead,” he said on June 24 from his post in Regina. “We should go forward with actions on certification that we have maintained. Click and try Bayer to deal fairly with (claims) in Canada.”
Bayer has thousands of legal cases in the United States and in other countries where the plaintiffs stated the effects of glyphosate (active ingredient in Roundup) have contributed to their cancer development.
Legal problems Bayer began after the company acquired Monsanto, manufacturer of roundup herbicide in 2016. The absorption was completed in 2018.
Payments of $10.1 to 10.9 billion. should solve most of the claims in America, said Bayer in a statement.
“(It) will close about 75% of current roundup of litigation involving about 125,000 filed and Unfiled claims in General,” said Bayer. “Allowed claim of the plaintiff of all legal firms roundup the Federal multi-district litigation or business crossroads California, and those that represent 95% of cases currently sent to the court.”
The majority of claims of glyphosate in the U.S., but Canadians also carries out legal actions on security glyphosate.
In may 2019, the merchant said his firm tried to confirm class action lawsuit against Bayer. The main plaintiff in the case is Harry Gadd, a farmer from moose jaw, Saskatchewan. Gadd argues that the impact of glyphosate contributed to his cancer. He was diagnosed with non-Hodgkin’s lymphoma in 2014.
In Canada, the judge shall confirm the case before it can act as a claim.
Initially, less than 12 Canadians have joined the cause.
As of the end of June, the number was much higher.
“A little more than 500,” a trader said.
In USA, buyer must make payment in the amount of $8.8 billion to 9.6 billion dollars to resolve the current roundup of litigation and $ 1.25 billion. to address possible future litigation.
Bayer has not admitted liability or wrongdoing.
Merchant, who is also a member of the bar Association in Arizona, said that the agreement between the United States and Bayer law firms have probably been in the works for some time.
“In my opinion… they have gone to large firms that have many ongoing cases, and they have an agreement, otherwise they would not have made this statement,” he said. “But they can’t announce this settlement because there are other (companies) that they can’t even communicate…. Their expectation-this is a company with several claims will go together with firms that are leading in the fight.”
In Canada, commercial law is not the only legal firm is pursuing a class action lawsuit against Bayer. Last summer, diamond & diamond lawyers, which has offices in Ontario, Alberta and British Columbia, have filed claims against Bayer and Monsanto in these three provinces.
He claimed that glyphosate was a factor in his clients suffering from cancer and said that suing Bayer for $500 million in damages.
It’s hard to know if and how the agreement the United States will affect the possible benefits, Bayer in Canada. However, Canadians are unable to receive the same compensation as the Americans.
“They (the chemical companies) always want to try and pay less for the people who suffered in Canada than they are prepared to pay in the United States,” said the merchant.
The lawsuits stem from the Decision in 2015 by the International Agency for research on cancer, a division of the world Health Organization
IARC scientists have classified glyphosate as probably carcinogenic to humans.
Since then, numerous regulatory bodies, including the Ministry of health of Canada and the United States Agency for environmental protection, analyzed the scientific evidence and concluded that the herbicide is safe.
“No regulatory Agency pesticides in the world currently considers glyphosate to be of carcinogenic risk to human health at the levels at which people are currently subjected,” the public health Agency of Canada said in January 2019.
Despite these findings, the national regulators, the number of claims glyphosate is expanded almost every day.
As of April, Bayer was presented to the 52,500 U.S. plaintiffs who accuse glyphosate-based herbicide to their cancer, compared with 48,600 in February, Reuters reported.
And law firms lined up tens of thousands of applicants.
These numbers are much less in Canada. But people continue to call the business law group would like to join their lawsuit.
Most people with non-Hodgkin’s lymphoma. It is a cancer of the lymphatic system of the body that fights disease.
“I would say that 90% of non-Hodgkin’s lymphoma,” merchant said last year. “In … a disproportionately large percentage in the three Prairie provinces and a lot in the area of the world. It is clear that they are from farming communities”.
