The applicant is directed to approach civil court against LDA
Lahore:the Lahore High court on Wednesday directed the mother of three children and physically retarded children in the civil court, the appropriate forum against the demolition of his house in Lahore development authority (LDA).
Suraya Kausar, the appellant filed a petition through counsel Sardar Balakh Sher Khosa referring to the fact that LDA was partially destroyed her home in Johar town, despite the order to halt passed civil court. She asked the court to restrain the LDA from the demolition of her house, and also order action against the officials involved in violation of an order of stay. Her three children were also brought to the High court in wheelchairs.
Justice Shams Mahmood Mirza said that the applicant has already filed a civil suit in respect of the house before the civil court. He noted that the civil court order to stay in favor of the plaintiff.
The judge noted that civil courts are courts of plenary jurisdiction and had all the credentials to satisfy the applicant’s complaint. “The applicant, therefore, aims to approach the civil court where the claim of the applicant is pending for the satisfaction of her complaint,” the judge wrote in the order and discussed in the statement of claim.
