A bench of seven members larger than the Supreme Court headed by Chief Justice Gulzar Ahmed on Thursday (April 30) was allowed to accept the request of the federal government led by Prime Minister Imran Khan to amend The Government of Gilgit Baltistan Order 2018 to hold elections in September and form an interim government during the interregnum period.

The Gilgit Baltistan government is currently led by Chief Minister Hafiz Hafeezur Rehman from PML (N).

He added, “The United Nations has asked Pakistan to establish local authority in Gilgit in 1947. The United Nations has asked Pakistan to refrain from material changes in occupied territories. The presence of Pakistani forces in Gilgit Baltistan is a material change”.

“No referendum on the political future of Gilgit Baltistan can be valid until all Pakistani citizens leave,” the activist said.

Sajjad Raja, Chair of the JKGBL National Equality Party said that no Pakistani court had the authority to allow the central government to interfere in Gilgit Baltistan’s internal affairs.

“Gilgit Baltistan has a Legislative Council and government, and the people of Gilgit Baltistan have the sole right to decide when and how they should hold elections and form an interim government. No Pakistani government or court has constitutional and legal rights to make any decisions in Gilgit affairs. Baltistan “, he told ANI.

In the Supreme Court, Pakistan’s Attorney General told the court that there was an Election Commission in Gilgit Baltistan, so there was no justification for interfering in the election process in Gilgit Baltistan.

Sajjad Raja said that based on the previous decision, the Supreme Court of Pakistan should issue instructions to the Pakistani government not to interfere in areas that are constitutionally not part of Pakistan. But because the Pakistani court is not independent, no fair or just constitutional or legal decision can be expected from this Pakistani court.

Professor Sajjad Raja said that Gilgit Baltistan is part of the state of Jammu and Kashmir and is a disputed territory. The Gilgit Baltistan region is not a constitutional part of Pakistan and Pakistan’s judicial jurisdiction is not constitutionally applicable to Gilgit Baltistan.

Gilgit Baltistan was illegally occupied by Pakistan and the United Nations has proposed to form a fully independent government in its affairs until the future of Gilgit Baltistan is decided, which was never recognized by Pakistan.

The king said that all Laws and Orders issued by the Government of Pakistan including Balgistan Gilgit Orders 2018, 2019 and the 2017 Election Law are unconstitutional and illegal. Neither the Pakistani President nor other institutions have constitutional authority to make administrative and constitutional decisions for Gilgit Baltistan.

“When the Pakistani court formally declared that Gilgit Baltistan was not part of Pakistan, it was illegal and unconstitutional for the Pakistani federal government to take administrative and constitutional matters of Gilgit Baltistan back to the Supreme Court of Pakistan. And that was an evil act,” the activist said.

The king said that the fact is that under the guise of the current Supreme Court decision, the Pakistani government wants to directly intervene in Gilgit Baltistan to form a puppet government in Gilgit Baltistan which is fully under the control of the federal government of Pakistan. “The aim is to take all decisions at will by destroying the voices of people from within Gilgit Baltistan,” he said.

Amjad Ayub Mirza, a journalist from PoK said, “Pakistan’s Supreme Court under pressure from the Pakistani Army has ordered the federal government led by Imran Khan to conduct elections in GB. This is because they want to get rid of the government’s Pakistan Muslim League (Nawaz) & replace it with the PTI government to have control of Gilgit Baltistan.
