German Supreme Court Sides Solvay in Patent Case With Neo | Business | Instant News


HANNOVER, Germany – (BUSINESS WIRE) – 14 Apr 2021–

On April 6, 2021, the German Federal Court (Bundesgerichtshof) ruled in favor of Solvay in the patent cancellation case filed by Neo Chemicals & Oxides (Europe) Ltd. against patents relating to recent ceric oxide products consisting of catalysts to minimize emissions. next-generation automotive engines, and catalysts comprising ceric oxide products.

The appeal case in the German Federal Court (Bundesgerichtshof) overturned the cancellation decision by the Federal Patent Court (Bundespatentgericht) in January 2019 regarding the German designation of patent EP 1 435 338 B1. This appeal decision is final and conclusive (file number X ZR 54/19 – BGH).

The Mannheim Regional Court (Landgericht Mannheim) decided in December 2017 that Neo Chemicals & Oxides (Europe) Ltd. (“Neo”) has infringed Solvay’s patent by supplying certain cerium oxide materials in Germany. In its judgment, the Mannheim court barred Neo and two of its directors from offering, marketing, using, or importing (or owning for that reason) infringing products in Germany. The court further held that Neo was responsible for damages in connection with their past sale of the infringing ceric oxide product and needed to provide a tally of the infringing activity. Neo appealed the decision to the High District Court (Oberlandesgericht) in Karlsruhe in January 2018. The infringement appeal has been adjourned by the Karlsruhe Court pending a Federal Court decision. With its final validity and conclusively established, the German infringement appeal process will continue. In addition, Solvay will seek compensation for patent infringement in German courts.

As previously announced, British courts in two cases also found the patents valid and infringed by Neo. Another British court case is underway to determine the amount of damages Neo must pay Solvay based on this offense.

Neo is part of the Chemicals and Oxides segment of the Neo Performance Materials Inc. group. The Chemicals and Oxides Segment production facilities are located in Zibo, China, and Sillamäe, Estonia.

Titomic & Néos to Produce Invar36 Face Plates in the UK | National | Instant News

Titomic has signed a Heads of Agreement with Neos International Limited to form a joint venture in the United Kingdom that will manufacture and sell Invar 36 Faceplates and multi-metal product solutions for the Aerospace, Defense, Automotive and Nuclear industries. This product will be manufactured using Titomic’s Kinetic Fusion (TKF) Technology and Neos’ specialist engineering and tooling expertise.

The Neos Titomic joint venture will increase the rapid delivery of Invar and Nickel Shell Tooling and related products to Aerospace and other vital sectors. The fast delivery of TKF-produced tools will assist in the adoption of next-generation carbon fiber composite technology, which is essential for the production of light fuel-efficient aircraft and equipment to support the UK’s Aircraft and Space Industry.

The joint venture will ensure the production of high-level molding tools, nickel equipment and Defense solutions across the UK supply chain, supporting Britain’s position on the next generation of aircraft.

Aircraft manufacturers routinely experience very long lead times for the tools required to manufacture carbon fiber components, caused by limitations in cast and forged manufacturing. To assist the industry in meeting this demand, Titomic has carried out extensive R&D over two years to validate TKF manufacturing for tools. This work has culminated in an effective manufacturing process and commercial relationship with Neos to bring the technology to the UK.

Traditionally, Invar tools are manufactured by billet or casting machines, each of which results in up to 90% waste of the porous material or tool. The TKF process overcomes this challenge by making the face plate a nearly clean shape which requires only 10-20% of the material to work to make the faceplate finished in much less time. With a porosity of only 0.5%, it exceeds all vacuum leak testing standards for aerospace carbon fiber molding.

With these benefits, clients reduce costs, waiting time and waste thereby increasing overall productivity.
