ISLAMABAD: The Election Commission of Pakistan (ECP) is adhering to its old time frame for holding elections for half of the Senate and has not yet advanced the voting schedule as Prime Minister Imran Khan wanted.

The vote will take place in early March, a few days before the newly elected senator takes the oath on March 11.

On February 11, the ECP will release an election schedule that will outline the various stages of the election process. Under the Elections Act 2017, the ECP is the sole authority to hold Senate elections. The process is spread out over various stages which will take around a month to complete if the 2018 election schedule becomes a guide.

In the previous Senate elections, the ECP had published the timetable on February 2, 2018 and voting had been held on March 3 in the four provincial assemblies. This process took almost a month. The ECP has released a separate timetable, spanning 28 days, for the election of two senators by the National Assembly.

The existing legal and constitutional scheme allows for Senate elections within a month before the termination of the retiring MPs. According to Article 224 (3) of the Constitution, elections to fill the vacant Senate seats upon the expiration of a member’s term of office will be held no earlier than 30 days immediately preceding the day on which vacancies will occur. Accordingly, elections will not be held more than a month before the end of the term of office of the remaining senator; it cannot be postponed after the end of the term of office. In 2018, oaths were given to newly elected senators on March 11, starting their term.

This exercise involves issuing a notification by the ECP to fill the upcoming vacant seats and setting the final date for submitting nomination documents, publication of the nominated candidate’s name, examination of candidate documents, appealing against acceptance / rejection of nominations, disposal of appeals by electoral courts, publication of lists of candidates revision and withdrawal of nominations.

The Election Law says Returning Officials (RO) “may, for examination purposes, ask any institution, authority or organization, including financial institutions, to produce any documents or records or provide information as may be required to determine the facts with regard to objections to the nomination of a contestant, however, he will not ask questions that are not related to the information provided in the newspapers, or which do not arise from objections raised by anyone or from information received during the examination.

“The RO will question the candidate’s statement that the candidate is eligible to enter and has met the voting statute requirements only if actual contradictory material is available in the records. He may, either by his own motion or against any objection, conduct a summary investigation and reject the nomination paper if he believes that the candidate does not meet the requirements, the applicant or a second party is not eligible to subscribe to the nomination paper; the law has not been obeyed or the statement is false or untrue in certain materials and the signature of the applicant or supporter is not original. The RO will not reject the nomination paper on the basis of any defect that is not substantial in nature and may permit the defect to be corrected immediately and will not investigate the correctness or validity of any entry in the electoral roll.

“The appeal against surveillance will be decided immediately within the time set by the ECP and any orders passed will be final. If, based on information or material known to any source, the court is of the opinion that the candidate whose candidacy has been accepted is a person who was negligent in loans, taxes, government fees and utility expenses or has had a written off loan or deliberately conceals the fact or suffers disqualification others of being elected to the Senate, perhaps, on his own motion, summoned him to point out reasons why his paper could not be rejected. “If the court believes that he is indeed an absentee or has a loan written off or disqualified, the nomination letter may be rejected.
